Terms of Service
The short version
- Our tools help you plan and forecast. The results are estimates, not financial, tax, legal or medical advice.
- Your data stays yours. Don't upload patient information.
- Be reasonable and keep your login private. We may suspend abusive accounts.
1. Agreement
These terms govern your use of Direct Care Analytics, Launch Planner and this website (the "Service"), provided by Raborn Decision Sciences LLC ("we", "us"). By creating an account or using the Service you agree to them and to our Privacy Policy. If you don't agree, don't use the Service.
2. What the Service does
The Service produces projections and planning figures from the information you provide and from public data sources. These are estimates based on your assumptions and past figures. They aren't a promise of results, and they aren't financial, tax, legal, accounting or medical advice. Check important decisions with your own advisors.
3. Your account
- You must be at least 18 and give accurate information.
- You're responsible for your login and for activity on your account. Tell us promptly if you suspect misuse.
- One account represents one practice.
4. Your data
- You keep ownership of what you enter or upload. You give us permission to process and store it only to provide the Service to you.
- Don't upload protected health information or patient-identifying details. The Service isn't designed for them, and we don't sign business associate agreements.
- You're responsible for having the right to upload what you upload.
5. Acceptable use
Don't attack, overload or probe the Service, share your login, resell access, scrape it, or use it to break the law or others' rights. We may suspend or end access for violations.
6. Plans and billing
The Free plan costs nothing. Paid plans are billed through Stripe on a recurring basis at the price shown at checkout. You can manage or cancel a subscription in Manage Billing. Plan features may change, and we'll give notice of material changes to paid plans.
7. Our property
We own the Service, its software, design and content, apart from your data and public data we license or cite. We grant you a limited, non-transferable right to use the Service for your own practice. Reports you generate are yours to use for your practice.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including fitness for a particular purpose and uninterrupted or error-free operation.
9. Limit of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits or business decisions made using the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $100 if you paid nothing.
10. Ending your use
You can stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We may suspend or end the Service or your access, with notice where practical.
11. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in Florida.
12. Changes
We may update these terms. Continuing to use the Service after a change means you accept it. We'll update the date above and email account holders about material changes.
